Delta-8 THC (D8 or Delta Eight) is an active ingredient in cannabis Sativa plants, also known as THC. The effects of delta eight THC are comparable to those of “delta-9 THC,” the most prevalent THC compound. Delta-9 THC (D9 or Delta Nine) is commonly known as medical marijuana or cannabis. D8 THC, while not as powerful as D9, is much more accessible for purchase without a medical card or a recreational marijuana program because it is derived from hemp and does not have the same rules & regulations as marijuana.

The hemp plant naturally contains D8 in extremely low percentages. Due to costs, it is not feasible to extract the delta-8 THC directly from the hemp plant. A majority of the delta-8 on the market is synthetically derived.

Delta eight THC is an isomer of CBD, meaning it offers a very similar chemical structure. It is also very similar in shape to Delta-9 THC. This small change in chemical structure gives delta-8 different properties from cannabinoids like CBD and THC.

Synthetic cannabinoids, or isomer cannabinoids, generally start as CBD isolate. The extract begins as crude oil and requires additional purification to refine the product to 99% pure CBD isolate. A processor can take that 99% pure CBD material and force a chemical reaction that converts the CBD into other cannabinoids, like D8 THC.

Converting CBD isolate to Delta-8 requires chemicals.

CBD refluxes in an organic solvent such as toluene or heptane with p-toluenesulfonic acid or another acid that acts as a catalyst, resulting in D8-THC. The reaction generally runs for 60–90 minutes.

Some delta-8 on the market carry an acidic profile and may even contain residual acids/solvents if the conversion process is not done correctly and with integrity.

Is Delta-8 THC legal?

The 2018 Farm Bill removed hemp plants and all derivatives, including cannabinoids like delta-8 THC, from the Controlled Substances Act. The Farm Bill made extracts from hemp federally legal as long as they contain less than 0.3% delta-9 THC on a dry weight basis. The DEA recently backed its position on isomers like delta-8 THC.
